1. General provisions
1.1. This Privacy Policy (hereinafter the "Policy") has been developed by MW Exchange in accordance with the applicable legislation of Ukraine, including the Law of Ukraine "On Personal Data Protection", with respect to Users of the Website https://www.mw.exchange/ and establishes the procedure for obtaining, collecting, accumulating, storing, processing, using, safeguarding and disclosing the personal data (hereinafter the "Data") of MW Exchange Users.
Data means any information relating directly or indirectly to a particular User (in accordance with clause 2 of this Policy).
Processing of Data means any operation with the Data, including but not limited to: access, provision, dissemination, collection, systematisation, storage, accumulation, recording, transfer, blocking, erasure, rectification, updating and/or alteration, depersonalisation. The data controller is MW Exchange.
1.2. Users may provide data themselves by posting it on the Website or by communicating it through telephone channels, to the email and/or postal address of the site, or the data may be provided from other sources (in accordance with clause 3 of this Policy), or it may be other information from third parties submitted in the course of filing claims, complaints and/or the consideration of disputes, and/or information from publicly available sources on the Internet.
1.3. By registering on the Website https://www.mw.exchange/ and/or by continuing to stay on the website, and/or by performing any actions on the Website, the User gives their voluntary, specific, informed and conscious consent, unlimited in time, to the processing, by any means provided for by the Law of Ukraine "On Personal Data Protection", of their personal data collected through the Website, to its entry into the relevant personal data bases of the data controller, and to its transfer and/or the granting of access to controllers without obtaining additional consent.
1.4. The User has no right to use the site https://www.mw.exchange/ if they do not agree with the terms of this Policy.
2. Data collected
MW Exchange may collect the following data:
- first name, last name, contact telephone numbers, email address and other communication details at the User's discretion;
- information about the User's account that is necessary to provide service and communicate with Users, including when the User contacts the support service;
- data about the devices used by the User or their mobile Data (where the User uses the mobile application), such as: ip address, the date and time when the User uses the Website, information about software, browser, information about the operating system of the mobile device, information about the operation of the User's devices, individual identifiers of the devices used by Users;
- data obtained as a result of various MW Exchange surveys related to improving the provision of service to Users;
- information obtained as a result of marketing activities;
- information posted by Users following the service they received, reviews, comments, enquiries to the support service, complaints, claims, etc.
The Data is processed using the following technologies:
- Cookies (a cookie is a fragment of data that is sent to the user's computer when visiting a web page and/or when viewing an advertising module on a web page and is stored on the user's computer and/or on their mobile device);
- pixels make it possible to track how often the User uses web pages in order to determine their browser, provide services, and also in order to fix errors of the Website https://www.mw.exchange/ initiated by the User. The information collected is processed in its original form and is not altered during the data collection process.
3. Purposes of data processing
MW Exchange uses and carries out the processing of Data in order to:
- perform the functions, powers and obligations assigned to it in accordance with the applicable legislation of Ukraine, and also to ensure the implementation of civil-law, commercial and tax relations;
- identify the client as a User of MW Exchange for the purpose of further communication (provision of services, payment processing, dispatch, carrying out settlement operations, record keeping, activity analysis, traffic management, analysis of Users' interests, publication of reviews).
The processing of your personal data may be carried out by MW Exchange for the purpose of:
- providing services that meet the User's needs;
- offering the solutions and services that best meet the User's needs, by means of mailings or by making a telephone call;
- showing the User advertisements based on actions on the Website;
- building a client base;
- determining the level of public interest in the services provided by the Website;
- improving the operation of the Website, increasing the convenience and efficiency of working with the Website.
4.Use of personal data
MW Exchange does not process Data concerning racial or ethnic origin, political opinions, religious or other beliefs, or membership of public associations.
Information characterising the physiological features of Users, on the basis of which their identity can be established, is not processed.
The periods for processing and storing the Data are determined on the basis of the purposes and conditions set out in the contracts concluded with Users in accordance with the requirements of the applicable legislation of Ukraine.
5. Conditions for granting access to data
In order to demonstrate the effectiveness of the Website https://www.mw.exchange/ and to enhance the image of the site, MW Exchange may disclose statistics on the operation of the Website without thereby disclosing personal data or information that constitutes a trade secret.
The Website may contain links to third-party web resources, to which this Policy does not apply when Users follow such links.
The Website processes data on a lawful and fair basis. The Data is not disclosed to third parties and is not disseminated without the User's consent, except in cases provided for by the applicable legislation of Ukraine and only in the interests of national security, economic well-being and human rights, in particular but not exclusively:
- upon substantiated requests from state authorities entitled to demand and receive such data;
- in the event that, in the opinion of MW Exchange, the User breaches the terms of this Policy and/or other contracts and agreements concluded between MW Exchange and the User, as well as the provisions of the User Agreement, the Rules for Posting Information on the Site, and the Rules for Publishing Reviews.
MW Exchange reserves the right, in accordance with the requirements of the applicable legislation of Ukraine, to exchange Data with state authorities for the purpose of: preventing fraud, settling disputed situations and ascertaining circumstances that may constitute or cause a breach of the applicable legislation, and also where MW Exchange detects unlawful actions by Users and/or receives claims, complaints or enquiries from third parties.
6. Amending or deleting data
At any time Users may amend their personal information, or unsubscribe from mailings, or withdraw their consent to the processing of the Data by sending a message to the email address [email protected] .
Upon receipt of the message, the processing of the User's Data will be terminated and the information will be deleted, except where it may be required in accordance with the applicable legislation of Ukraine.
MW Exchange processes and stores data in order to achieve the purposes set out in this Policy for the entire period necessary for this.
7. Data protection
When processing the Data, MW Exchange applies all necessary technical, organisational and legal measures to protect the Data from unlawful and/or unauthorised access to such Data, including alteration, deletion, provision, dissemination and other unlawful actions.
MW Exchange monitors the security measures taken on an ongoing basis.
8. Additional terms
MW Exchange reserves the right to change the terms of this Policy at any time. In that case, the updated version will be posted on a page of the Website. If the User does not agree with the changes, they undertake to immediately cease any interaction with MW Exchange.
MW Exchange is not liable for any losses or damage incurred by the User or third parties as a result of a mistaken understanding or a failure to understand the terms of this Policy.
If any provision of this Policy, including any sentence, clause or part thereof, is found to contradict the applicable legislation of Ukraine or to be invalid, this shall not affect the other provisions, which remain fully effective and continue to operate in full force and are valid, and any invalid or unenforceable provision shall, without further action by the Parties, be deemed amended and corrected to the extent necessary to ensure its validity and enforceability.
The terminology used in this Policy has the same meaning as in the User Agreement, unless otherwise stated.
